Himson Engineering Issues Public Notice On Oerlikon Patent Rights In India

Himson Engineering Private Limited, Surat, has issued a public notice informing the industry about patent rights held by Oerlikon Textile GmbH & Co. KG, Germany, in relation to false-twist texturising technology used in manmade fibre applications.

As per the notice, Oerlikon is the registered proprietor of Indian Patent No. 316763, titled ‘A False-Twist Texturing Machine for the Texturing of a Plurality of Multifilament Threads’, which is valid and subsisting under Indian law. Himson Engineering has been granted a sole licence by Oerlikon to use, manufacture, market and commercialise the patented technology within India.

The notice cautions that any unauthorised manufacture, sale, import or commercial dealing in products or processes falling within the scope of the patented technology would constitute patent infringement under the Patents Act, 1970, attracting legal consequences including injunctions, damages and recovery of losses.

Himson Engineering stated that both it and Oerlikon reserve the right to initiate appropriate legal action against any individual or entity found infringing or assisting in the infringement of the patented technology.

The public notice has been issued as a formal caution to industry participants to avoid unauthorised use of the patented technology.
