Dow Receives CAD $1.8 Bn From NOVA Chemicals After Appeal Court Decision

Dow has confirmed receiving CAD $1.62 billion (about USD $1.2 billion) in damages from NOVA Chemicals following a decision by the Alberta Court of Appeal to deny NOVA’s request to stay execution of a June 2025 judgment during its appeal.
The ruling relates to NOVA’s failure to operate a jointly owned ethylene facility in Joffre at full capacity. The June 2025 decision by the Court of King’s Bench of Alberta expanded the loss period previously considered by the court and awarded additional damages to Dow.
In addition to the damages, Dow also received CAD $140 million in legal costs and post-judgment interest, bringing the total payment to approximately CAD $1.8 billion (around USD$ 1.3 billion).
The payment is subject to Canadian tax withholding, which Dow expects will be fully remitted back to the company by the end of the year.
The latest ruling follows an earlier 2019 judgment, when the court ordered NOVA to pay CAD $1.43 billion to Dow after finding that NOVA breached contractual obligations between 2001 and 2012.
Dow said it expects the Alberta Court of Appeal to ultimately uphold the rulings currently under appeal.
